A man accused of shooting at his ex-girlfriend after a physical fight between the two pleaded guilty to lesser charges Wednesday in Madison District Court.
Kevin Carter, 24, of Berea Road, had been charged with first-degree wanton endangerment, but as part of a plea agreement, he pleaded guilty to criminal attempt to commit fourth-degree assault, a Class A misdemeanor.
Had Carter been convicted of the original charge, he could have faced up to five years in prison.
His 90-day sentence was probated for two years, and he is required to undergo a drug treatment assessment and take anger management classes.
Carter had been scheduled to appear for a preliminary hearing in the case.
On Aug. 22, deputies with the Madison County Sheriff’s Office were called to a domestic dispute at Battlefield Apartments.
Carter’s ex-girlfriend, Kimberly Combess, 24, of North 3rd Street, had come to the apartments to confront Carter, according to Deputy Philip Sturgill.
The two got into a “physical” altercation when Combess’ new boyfriend came upon the scene, saw the two fighting and tackled Carter. Carter then ran inside an apartment, grabbed a gun and fired two “warning shots,” Sturgill said. One of those shots was fired at Combess, he said.
Combess was scheduled for a preliminary hearing on a charge of fourth-degree assault, but Judge Brandy O. Brown dismissed the charge because of a lack of probable cause before the hearing could take place.
