RICHMOND —
A Richmond man was arrested and charged with first-degree rape Friday in a case dating back to May 2010.
Ricky Hacker, 46, of Richmond, was arrested at his residence by Richmond Police Detective Eric Long, according to Chief Larry Brock.
On May 27, 2010, a woman was visiting friends at a home in the 500 block of Ballard Drive, Brock said. She told police she went to sleep in a bedroom in the early morning hours, while Hacker and another man were at the residence. The two men were awake in another room when the woman fell asleep, she told police.
The woman later awoke to find Hacker sexually assaulting her, Brock said. All parties reportedly were consuming alcohol.
The woman went to the hospital and physical evidence was collected through the use of a rape kit, the police chief said. Samples were sent to the state crime lab in Frankfort for analysis.
The RPD recently received the results of the evidence testing, 19 months after the alleged assault happened.
“Those results implicated Hacker,” Brock said Friday.
It is not uncommon for sexual assault evidence testing to take more than a year, he said.
Brock acknowledged that the long delay makes investigating sex crimes more difficult, often putting investigations in a “holding pattern” until physical evidence is analyzed.
Sometimes victims and alleged perpetrators move out of the area. In this case, Brock said the victim has moved out of state.
He added that the backlog in state crime lab testing leads to victims feeling like their case is not being taken seriously, and justice is not being served, when it takes more than a year to make an arrest.
Hacker has been jailed in Madison County numerous times for public intoxication and failure to appear in court, according to jail records. He has also been jailed on assault, theft and trespassing charges.
Hacker is lodged at the Madison County Detention Center. A bond had not been set for him as of Friday evening, according to jail officials.

Man is indicted on additional sex charge involving teen in 1998
A man already accused of sex abuse in November 2011 has been indicted on a charge of first-degree rape involving a child in 1998.
Charles W. Peyton, 63, of East Irvine Street, was indicted Wednesday by a Madison grand jury. He used “forcible compulsion” to have sexual intercourse with a 14-year-old girl between March 1 and May 1 in 1998, according to the indictment. -

Officers responded to a call in the 1000 block of Scaffold Cane Road about a man trying to break into a home, according to a release from BPD Public Information Officer Jake Reed. -

The Madison County Animal Shelter is located at 1386 Richmond Road in Berea. Shelter hours are 9 a.m. to 5 p.m. Monday through Friday and 9 a.m. to 4 p.m. Saturday.
