RICHMOND —
A Madison grand jury has indicted three people in connection with multiple instances of sexual abuse, rape and sodomy of an 11-year-old child.
Eric Nelson Kelley, 30, was indicted Wednesday on two counts of first-degree sodomy, and one count each of first-degree rape, first-degree sexual abuse and use of a minor in a sexual performance.
Deanna Lawson was indicted on charges of complicity in all the charges against Kelley for “failing to make an effort to prevent the acts … with the intention of promoting or facilitating those offenses” perpetrated against the child.
Under Kentucky law, complicity to a crime incurs the same penalty as perpetrating the crime.
In a separate indictment, Robbie Lynn Uhrin, 58, was indicted on a charge of first-degree sodomy involving the same child.
The crimes are alleged to have occurred between Oct. 1, 2011, and Sept. 11.
Kelley was indicted on a charge of use of a minor in a sexual performance because he videotaped/photographed the child while she was engaged in a sexual activity, according to the indictment.
The first-degree rape and sodomy charges are Class A felonies, punishable by 20 year to life in prison. Use of a minor in a sex performance is a Class B felony, which carries a sentence of 10 to 20 years in prison, and first-degree sexual abuse is a Class C felony, punishable by five to 10 years in prison.
Kelley and Uhrin were both arrested Nov. 19 by the Madison County Sheriff’s Department. Uhrin remains in the Madison County Detention Center under a $10,000 bond, and Kelley is still in jail under a $50,000 bond.
Commonwealth’s Attorney David Smith said a warrant is in the process of being issued for Lawson’s arrest.
Other indictments Wednesday:
• Shane B. Gulley, first-degree sexual abuse, third-degree rape and third-degree sodomy.
• Ricky D. Guillen, cultivation of marijuana (five or more plants), possession of a handgun by a convicted felony, possession of a firearm by a convicted felon and second-degree persistent felony offender.
• Carla Rae Clontz, two counts of first-degree trafficking in controlled substance (subsequent offense, Class C felony), first-degree trafficking in controlled substance (subsequent offense, Class B felony), third-degree trafficking in a controlled substance, trafficking in marijuana (less than 8 ounces) and possession of drug paraphernalia.
• Morgan Richardson, false statement or misrepresentation to receive benefits over $100.
• Whitney Smith, false statement or misrepresentation to receive benefits over $100.
• Bud Hembree, making false statement to obtain increase of benefits over $100, first-degree persistent felony offender.
• Charles R. Robertson, third-degree burglary and theft of a controlled substance.
• Clell Swinney Jr., second-degree assault.
• Donna Campbell, two counts of second-degree criminal possession of a forged instrument and two counts of theft by deception.
• Daniel Pigg, third-degree burglary.
• Tawanna M. Isaacs, first-degree trafficking in a controlled substance.
• Theoddeus Gray, possession of a handgun by a convicted felon.
An indictment is a formal statement of charges and does not imply guilt, only that grand jurors believe the state has enough evidence to prosecute.
