Shooting suspect Gay is released on reduced bond

Man was out of bond when arrested

MADISON COUNTY — The man charged with shooting someone within hours of being released from jail in November is once again free on bond after a court appearance Wednesday.

Tony Ray Gay, 21, is charged with first-degree assault, four counts of first-degree wanton endangerment and possession of a handgun by a convicted felon in the Nov. 19 incident.

The victim suffered a bullet wound to his abdomen and was expected to recover after being hospitalized, according to the Richmond police.

Surveillance video from a nearby business captured images of the incident, which happened outside. The suspect fled the scene in a 2001 Ford Taurus.

Madison County Sheriff’s Department deputies arrested Gay the next day.

Madison County Detention Center records show that Gay had been arrested at 10:13 a.m. the day of the shooting on a charge of failure to pay child support. He was released from jail at 2:54 p.m. on a $7,500 bond.

The shooting occurred at 4 p.m., according to the RPD.

Gay appeared in district court Wednesday morning and a preliminary hearing was conducted, according to court records. Judge Charles Hardin found probable cause, and the case was waived to a grand jury.

Also during the hearing, Gay’s bond was reduced from $50,000 to $10,000 cash or property with the conditions he has no further violations of the law and no contact with the victim, according to court documents.

Gay was released from the Madison County Detention Center following the hearing, according to online jail records.

Court documents list Jim Baechtold as Gay’s attorney.

If a Madison County grand jury indicts Gay on felony charges, the case will proceed in circuit court. Gay’s most serious charge, first-degree assault, is a Class B felony that carries a sentence of 10 to 20 years in prison.
